1. Agreement to Terms

By accessing and placing an order on www.JimGarrettMerch.com operated by Jim Garrett Merch, LLC you agree to these Terms of Service. If you do not agree, do not use our Site.

2. Custom Made Products

All products are custom made to order. Each item is made specifically for you after you place your order.

a) You understand and agree that custom items require production time: [10-15 business days] before shipping.

b) Because items are custom made, you cannot cancel, change, or return an order once production has begun. Please review size, color, and spelling carefully before checkout.

c) Slight variations in color, placement, and size may occur due to the custom printing process. This is not considered a defect.

3. Pricing & Payments

All prices are in USD. Prices may change at any time without notice. We are not liable for typographical errors in pricing. We use secure third-party payment processors [Shopify Payments, PayPal, etc.]. We do not store your full credit card information.

4. Our Intellectual Property

All content on our Site, including our own designs, logos, photos, and text, is owned by Jim Garrett Merch and protected by copyright. You may not copy, reproduce, or resell any of our designs without permission.

5. Shipping & Delivery

Shipping times are estimates. See our separate Shipping Policy. We are not responsible for delays caused by carriers, customs, weather, or incorrect addresses provided by you.

6. Returns, Exchanges & Defects - Custom Orders

Due to the custom nature, all sales are final unless the item arrives defective or incorrect.

If your item is defective, damaged, or we made a mistake, contact us within 7 days of delivery at KittrellJim@gmail.com with photos. We will repair or replace it at no cost. We do not offer refunds for buyer's remorse, wrong size ordered, or spelling errors provided by the customer.

7. Prohibited Uses

You agree not to use the Site for any unlawful purpose, to attempt to hack the Site, to upload viruses, or to use our products to harass or infringe on others.

8. Disclaimer & Limitation of Liability

Our Site and products are provided "as is." To the fullest extent permitted by law, Jim Garrett Merch is not liable for any indirect, incidental, or consequential damages arising from your use of the Site or products. Our total liability shall not exceed the amount you paid for the order.

9. Indemnification

You agree to indemnify and hold harmless Jim Garrett Merch from any claims, damages, or expenses arising from your Customer Content or violation of these Terms.

10. Governing Law

These Terms shall be governed by the laws of the State of Florida and North Carolina, without regard to conflict of law principles.

11. Changes to Terms

We may update these Terms at any time. Changes are effective when posted on the Site. Continued use of the Site after changes constitutes acceptance.
